Terms of Service

1. Agreement to terms

By accessing or using The Productivity Kit ("the Service"), available at the-productivity-kit.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

The Productivity Kit is a professional invoicing application designed for tradespeople and freelancers. It allows you to create invoices, attach photos of completed work, collect client signatures, send invoices, accept payments, and automate payment reminders.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account.

4. Plans and pricing

• Free plan: Includes up to 5 active invoices, 10 contacts, PDF downloads (with watermark), multiple currencies, and tax calculations. Available indefinitely at no cost.
• Pro plan: Includes unlimited invoices and contacts, photo attachments, client approval with signatures, automated chasing, voice invoice creation, email delivery, online payments, clean PDFs, and recurring invoices. Billed monthly.

Prices are displayed in your local currency where supported. We reserve the right to change pricing with 30 days' notice.

5. Payment and billing

Pro plan payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you will retain Pro access until then.

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us and we will review your case.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to send fraudulent invoices.
• Attempt to gain unauthorised access to the Service or its infrastructure.
• Upload malicious content, viruses, or harmful code.
• Resell, redistribute, or sublicense the Service without our written consent.
• Use the Service in a way that could damage, disable, or impair it for other users.

7. Your content

You retain ownership of all content you create using the Service, including invoices, photos, business information, and client data. You grant us a limited licence to store, process, and transmit this content solely to provide the Service to you.

You are responsible for ensuring you have the right to use and share any content you upload, including photos and client information.

8. Intellectual property

The Service, including its design, code, branding, and documentation, is owned by The Productivity Kit and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

9. Limitation of liability

To the maximum extent permitted by law, The Productivity Kit and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.

11. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm other users or our infrastructure. Upon termination, your right to use the Service ceases immediately.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
